Family law business valuation in Melbourne

Family Law Valuations provides business valuations for separating couples and family lawyers in Melbourne and across Victoria. The practice is based in Sydney and has no premises in Melbourne: every Victorian engagement is run remotely, from the business records and conversations with the owner. The fees are the same in every state and territory: a Settlement Valuation is $2,495 + GST and a Family Law Expert Valuation is $4,495 + GST, both fixed and confirmed in writing before work starts.

How a Melbourne engagement runs

Remotely, and in the same order as any other: a conflict check, a written scope and fixed fee, a document checklist, the analysis, a draft for factual review, then the final report. Melbourne and Sydney keep the same time all year, so the published phone hours, 8am to 6pm, Monday to Friday (Sydney time), are the same hours in Melbourne.

A business valuation does not depend on the valuer being in the same city as the business. It depends on the financial statements, tax returns, management accounts and ownership documents, and on understanding how the business earns its income and how far that depends on the owner. If the valuer needs to see premises, plant or stock to form a view, that is raised at the scope stage, before the fee is confirmed.

Which court hears a Melbourne family law matter

Family law property matters in Victoria are heard by the Federal Circuit and Family Court of Australia, which sits in Melbourne. The Family Law Act 1975 is Commonwealth legislation, so the framework for a property settlement in Melbourne is the same one that applies in Sydney, and a valuer does not need to be based in Victoria to value a Victorian business.

For negotiation and mediation, the Settlement Valuation is the report. Where the value of the business is to go before the Court, the Family Law Expert Valuation is prepared for proceedings. Your lawyer will advise which your matter needs.

If the valuer is needed at a Melbourne hearing

Not every valuation is tested at a hearing. Where a Family Law Expert Valuation is, and the expert is required for cross-examination, attendance is charged separately from the fixed fee: remote attendance is $650 + GST per hour, four-hour minimum, and attendance in person in Melbourne is $6,500 + GST per day, plus travel and accommodation at cost. Those rates are published on the fees page so the cost of a contested hearing is known before the report is commissioned.

Questions from Melbourne

Other cities: Sydney, Brisbane, Perth, Adelaide, Canberra.

Do you have an office in Melbourne?

No. Family Law Valuations has one address, in Double Bay, Sydney. Melbourne engagements are run remotely by phone and document exchange, on the same fixed fees as anywhere else in Australia.

Can a Sydney-based valuer value a Melbourne business for a family law matter?

Yes. The Family Law Act 1975 is Commonwealth legislation and the valuation is built from the business records, not from where the valuer sits. Whether a particular valuer suits a particular matter is settled at the conflict check and scope stage, and for proceedings by the parties, their lawyers and the Court.

How much does a family law business valuation cost in Melbourne?

The same as everywhere else: $2,495 + GST for a Settlement Valuation and $4,495 + GST for a Family Law Expert Valuation, both fixed. There is no interstate loading on either report. See fees and inclusions.

Would the valuer have to travel to Melbourne for court?

Only if the valuer is required to give evidence, which applies to a Family Law Expert Valuation and not to a Settlement Valuation. Attendance is not part of either fixed fee. Remote attendance is $650 + GST per hour, four-hour minimum. Attendance in person in Melbourne is $6,500 + GST per day, plus travel and accommodation at cost. Whether the expert attends remotely or in person is decided by the Court, not by the valuer or the parties alone.
